Trademarks are filed for registration at the Turkish Patent and Trademark Office (hereinafter referred to as the Office). The registration procedure takes approximately 6-8 months from the application date but the Office is not bound by any deadlines though.
The application process includes a formal examination, the classification examination, and the absolute ground examination including prior right search. In case there are no obstacles to registration, the Office publishes the trademark for opposition purposes.
Trademark applications made to the Office before the date of publication of the new IP Code No. 6769 (January 10, 2017) will be subject to legislation in force at the date of application. The opposition period is 2 months for trademark applications filed on or after January 10, 2017, and the opposition period is 3 months for trademark applications filed before January 10, 2017.
The trademark is registered at the end of the opposition period, if there has been no opposition filed or if the opposition was successfully defeated, provided that the registration fee is paid. There is no further examination after the registration.
The validity period of trademark registration is ten years counted from the date of application.
